1. Scope and Provider

(1) These Terms of Service apply to the use of the music streaming platform "The Riff" (hereinafter "Platform").

(2) The Platform is operated by:

(3) These Terms apply to all users of the Platform (hereinafter "you" or "User"). Deviating terms of the User shall not be recognized unless we expressly agree to their validity in writing.

(4) Contractual language is English.

2. Description of Services

(1) The Riff is a music streaming platform for curated work music. The Platform provides access to a curated music catalog, available exclusively via streaming (no downloads).

(2) We offer the following usage models:

a) Free
Access to up to 5 tracks per day. Limited features.

b) Pro (paid)
Unlimited access to the entire music catalog. All Platform features.
Monthly: 9.99 EUR incl. VAT
Annually: 89.00 EUR incl. VAT

(3) All prices listed are final prices and include the applicable value-added tax.

(4) We reserve the right to modify, expand, or remove individual titles from the music catalog at any time. There is no entitlement to specific titles.

(5) We strive for high availability of the Platform but cannot guarantee uninterrupted availability.

3. Registration and User Account

(1) Registration is required to use paid features. You must provide truthful and complete information during registration.

(2) You are responsible for keeping your login credentials confidential. Your account may not be shared with third parties.

(3) You must be at least 16 years old to create an account.

4. Conclusion of Contract

(1) The display of subscriptions on the Platform does not constitute a binding offer but an invitation to submit an offer.

(2) By clicking the Subscribe button, you submit a binding offer to enter into a subscription agreement. The contract is concluded when we confirm payment and activate access.

5. Prices and Payment

(1) The currently applicable prices are:
Pro monthly: 9.99 EUR incl. VAT
Pro annually: 89.00 EUR incl. VAT

(2) Payment is processed through the payment service provider Stripe Payments Europe, Ltd. (Ireland). Payment methods: credit card (Visa, Mastercard) and SEPA direct debit.

(3) In the event of a failed payment, we reserve the right to restrict access to paid features.

(4) Price changes will be announced at least 30 days in advance by email.

6. Term and Cancellation

(1) The monthly subscription has no minimum term and renews automatically for one additional month at a time.

(2) You may cancel your subscription at any time, effective at the end of the current billing period -- in your account settings or by email to sendmail@efp-berlin.com.

(3) After cancellation, your access remains active until the end of the already paid period. Afterwards, your account will be downgraded to Free.

7. Right of Withdrawal

Withdrawal Right

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (efp berlin GbR, Stresemannstr. 23, 10963 Berlin, Germany, Email: sendmail@efp-berlin.com) by means of a clear statement of your decision to withdraw from this contract.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than within 14 days.

Early Expiration of the Right of Withdrawal

If you have requested that the provision of digital content (music streaming) begin before the expiration of the withdrawal period, and you have confirmed your knowledge that you thereby lose your right of withdrawal, your right of withdrawal expires upon commencement of contract performance.

8. Usage Rights to Music

(1) The music available on the Platform is licensed under Creative Commons licenses (CC-BY 4.0 or CC0) by the respective artists.

(2) You receive a simple, non-transferable right to listen to the music via streaming. For personal, non-public use only.

(3) The following is not permitted: downloading, copying, recording, public playback, sharing of access, use of automated tools, circumvention of technical protection measures.

9. User Obligations

You agree to use the Platform only within the scope of these Terms and applicable laws, not to provide false information, and to protect your login credentials.

10. Liability

(1) We are liable without limitation for damages arising from injury to life, body, or health, as well as in cases of intent and gross negligence.

(2) In cases of slight negligence, we are only liable for breach of material contractual obligations, limited to foreseeable damages.

(3) The Riff is operated by efp berlin GbR. The partners are personally and jointly liable for obligations of the company.

11. Data Protection

We process your personal data in accordance with the GDPR. Details can be found in our Privacy Policy. Your data is stored on a server in Germany.

12. Amendments to the Terms

We will notify you of any changes at least 30 days before they take effect by email. If you object, your subscription will end at the next cancellation date.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

(1) The laws of the Federal Republic of Germany shall apply. Mandatory consumer protection provisions of the state in which you have your habitual residence shall remain unaffected (Art. 6(2) Rome I Regulation).
(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction for merchants is Berlin. Consumers may file claims at the court of their place of residence (Art. 18 Brussels Ia Regulation).
